If you pass away prior to your children’s eighteenth birthday, the person who will be legally responsible for them. In normal circumstances if the children’s other parent is still alive when you pass away they will automatically become legally responsible. It’s important to ensure that the named guardian consents to the role prior to being named. Alternative guardians can also be named, who will become legally responsible if the primary guardian has passed away or is otherwise unable to become legally responsible for your children.
